Collection of your Personal Information

As a commercial web site, metersystems.co.za collects personal information, such as your e-mail address, name, home or work address or telephone number. Information collected by Africa Parts Group is used solely for the purpose online activity within the domain of www.apgonline.co.za. Africa Parts Group does not collect any information about your computer hardware and software.

Africa Parts Group encourages you to review the privacy statements of web sites you choose to link to from www.apgonline.co.za so that you can understand how those web sites collect, use and share your information.

We are not responsible for the privacy statements or other content on web sites outside of the Africa Parts Group web site.

Use of your Personal Information.

Africa Parts Group and its operational service partners collect and use your personal information to process services requested.

Africa Parts Group does not sell, rent or lease its customer lists to third parties. Africa Parts Group will not contact you on behalf of external business partners about a particular offering that may be of interest to you.

We occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings, providing customer support, processing transactions, or performing statistical analysis of our services. We will only provide those companies the personal information they need to deliver the service. They are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose.

Africa Parts Group does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

Africa Parts Group may access and/or disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to:

  • conform to the edicts of the law or comply with legal process served on Africa Parts Group or the site;
  • protect and defend the rights or property of Africa Parts Group, including its web site; or

Personal information collected on this site may be stored and processed in the Republic of South Africa or any other country in which Africa Parts Group or its affiliates, subsidiaries or agents maintain facilities, and by using this site, you consent to any such transfer of information outside of your country.

Security of your Personal Information

Africa Parts Group is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information you provide on computer systems with limited access that are located in controlled facilities.

AGREEMENT REGULATING ACCESS, PROCESSING & STORAGE PERSONAL INFORMATION IN TERMS OF THE PROTECTION OF PERSONAL INFORMATION ACT (“POPIA”)

AFRICA PARTS GROUP (PTY) LTD, Registration Number 2005/022801/07 (“the Company”) is committed to compliance with the Protection of Personal Information Act. No. 4 2013 (“POPIA”).

In this agreement, the following words bear the meanings associated with them below:

“Personal Information” means information relating to an identifiable, living, natural person, including:

1)    Financial information related to a person, including information provided by the Customer, or information obtained from a Credit Bureaux or from CIPC (the Companies and Intellectual Property Commission);

2)    Any identifying number, symbol, email address, physical address, telephone number, location information, online identifier or other particular assignment to the person; and/or

3)    The name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about that person.

Data Subject” means each director of the Customer and each shareholder of the Company that is a natural person.

WHEREAS:

In the course of the Company’s customer verification and credit vetting processes, the Company will collect and process Personal Information related to Data Subjects.

The Company is committed to ensuring that any processing of Personal Information related to Data Subjects is limited to the express purposes of opening and management of an account for the Customer and that such processing is compliant with POPIA.

IT IS HEREBY AGREED THAT:

  1. The Customer consents to the Company:The Customer consents to the collection, processing and storage of Personal Information by the Company related to Data Subjects, for the purposes of both the opening and ongoing management of a customer account.
    1. performing a credit search on the Customer’s record, as well as the record of Data Subjects, with one or more of the registered Credit Bureaux when assessing the Customer’s Application for Credit (and at any other time in the Company’s discretion);
    2. recording the existence of the Customer’s account with any Credit Bureau; and/or
    3. recording and transmitting details of how the Customer has performed and how the account is conducted by the Customer in meeting its obligations on the account, including to a Credit Bureaux and the Company’s credit insurers.
  2. The Customer warrants and represents that:The Customer warrants that all Personal Information supplied to the Company is accurate, up to date, is not misleading and that it is complete in all respects.
    1. it has concluded a contract with each Data Subject; and that in terms of such contract, the Customer has obtained the consent from such person to the processing of Personal Information by suppliers in the credit vetting process; and
    2. the processing of Personal Information by the Company is necessary for the legitimate interests of the Company in the Company’s credit vetting process.
  3. The Customer undertakes to immediately advise the Company of any changes to the relevant Personal Information of a Data Subject, but not limited to, a change of ownership or control in the Customer.
  4. The Company undertakes:
    1. to act in accordance with POPIA in relation to the collection, processing and storing of Personal Information related to the Customer. The processing of Personal Information by the Company will be limited to the purposes set out herein and will not be excessive;
    2. not to disclose the Customer’s Personal Information unless it is legally or contractually required or for its legitimate business purposes; and
    3. to use reasonable efforts in order to ensure that Personal Information related to Data Subjects in its possession or processed on its behalf is:

  1. The Customer acknowledges and agrees that any information regarding its credit worthiness, defaults in payment to the Company, and details of it account with the Company is conducted may be disclosed to any other creditor of the Customer or any registered Credit Bureaux, after 21 (twenty-one) days’ notice having been given to the Customer.

i.               kept confidential;

ii.              stored in a secure manner; and

iii.              processed in terms of the provisions of POPIA, and, for the purposes for which the Company has been authorised;

  1. to take reasonable steps to identify risks associated with the processing of the Customer’s information and establish safeguards against any such identified risks; and
  2. to take reasonable steps to ensure that the Customer is notified in the event of a breach of the confidentiality of the Customers Personal Information.

  1. The Customer has a right to lodge a complaint with the information Regulator if the Customer if it is of the view that its rights in terms of POPIA have been breached. The contact details of the information Regulator are:

Changes to this Statement

Africa Parts Group will occasionally update this Statement of Privacy to reflect company and customer feedback. If there are material changes to this Statement or in how Africa Parts Group will use your personal information, Africa Parts Group will prominently post such changes prior to implementing the change. Africa Parts Group encourages you to periodically review this Statement to be informed of how Africa Parts Group is protecting your information.
